  • Temporary relief: Once a divorce or separate maintenance suit has been filed, the court has the power to grant temporary (or pendente lite) custody, visitation, child support, spousal support, health insurance, orders for payment of debts, attorney's fees and other relief.
  • Spousal support (alimony): When determining spousal support, the court considers several factors outlined in Virginia State Law. The court may also grant the reservation of the right to ask for spousal support in the future.
  • Property division and asset/debt distribution: When married persons divorce, their marital property, stocks, bonds, business interests, retirement funds and debt are divided in a fair manner. Assets such as real estate and bank accounts, and debts such as student loans and credit cards will be divided in a fair, but not necessarily equal manner.
  • Child custody: Custody determinations are based upon the best interests of the child. The court considers statutorily mandated factors set forth in the Virginia Code.
  • Child support: Child support is calculated based upon a formula set forth in the Virginia Code. The formula takes into consideration the respective incomes of the parents, the health insurance costs for the children, work-related daycare costs, the number of children and the schedule of time the parents have with the children.
  • Visitation: The court considers the child custody factors when determining the schedule for visitation.
